Case History #1

Charge: DUI

  • This April, I appeared in Court and was able to secure the dismissal of a DUI case with the Deputy District Attorney at the Torrance Court House located at 825 Maple Ave., Torrance, California 90503.

    My client, a Rancho Palos Verdes professional, was not only at risk of suffering a conviction for DUI but perhaps most importantly was likely facing serious professional consequences. So what was our defense strategy? The truth of the matter is that the Constitution and the Rule of Law dictated the strategy and led to the only result possible. Let me explain.

    Under the 4th Amendment to the United States Constitution, all of us are protected from unlawful searches and seizures. If our 4th Amendment rights are violated the consequence is generally the suppression of any evidence obtained after the illegal act. In cases where a police officer makes a traffic stop the officer must have reasonable suspicion to do so. This generally includes the observation of a moving violation or an equipment violation as described in the vehicle code. I hope I haven’t lost you yet!

    Let’s get to my client’s case. The Rancho Palos Verdes arresting officer indicated she stopped my client for a violation of Vehicle Code section 21658(a) which requires that a vehicle be driven “nearly as practical entirely within a single lane…”. Seems clear enough, right? But what about a driver that weaves within the lane, or whose wheel or wheels touches a roadway’s painted line or perhaps even crosses the line? What if the touching or the crossing is minimal? What if the crossing is very brief?

    The answers to these questions have been answered in a number of cases both in the federal and state courts.

    In the federal courts, the Case of United States vs. Colin held that an isolated incident of a vehicle crossing the emergency lane of a roadway does not violate the code. In the state case of People vs. Perez, the Court found that in order for a stop to be justified there must be pronounced weaving for a substantial distance. Which brings me back to this case.

    I filed a motion contesting the stop of my client’s car with the Los Angeles Superior Court, Torrance. Technically, it is called a motion to suppress evidence under California Penal Code section 1538.5. The burden is on the Torrance District Attorney to show justification for the stop.

    The Torrance District Attorney called the Rancho Palos Verdes Police Officer to testify. The Rancho Palos Verdes Police Officer testified to what she perceived to be a violation of the Code as indicated but ultimately through my examination and that of the Torrance Court, it became clear that pronounced weaving for a substantial distance could not be established by the evidence.

    This is not to say the Rancho Palos Verdes Police Officer lacked credibility. To the contrary, the Torrance Court found The Rancho Palos Verdes Police Officer credible. It was just clear that her observations did not justify the stop and violated the 4th Amendment.

Case Resolution:

  • The case was dismissed after the Torrance Court ruled that the stop of the vehicle by the Rancho Palos Verdes Police Department was without reasonable suspicion and therefore suppressed all evidence obtained thereafter including all of the observations of the Police Officer, all of her conversations with my client, the field sobriety tests and all evidence of impairment.

    The suppression remedy is designed to protect all of our civil liberties and to prevent overreaching by the government. I can understand why some would deem this result harsh and perhaps even unjust, but I would ask you consider the reason for the rule: to support and give real effect to the civil rights we all cherish, including, as in this case, the right not to be detained or stopped without legal cause.

    I have defended criminal and DUI cases in the Torrance Court for over 30 years and was very pleased with this result.
