As human beings, we are imperfect. Today I represented a client on a serious felony matter in Riverside, our 6th appearance.
The Riverside Attorney’s Office insisted on a state prison commitment of 16 months. My client, a resident of Riverside County, supports a wife and 3 children through his work. State prison would have been a devastating blow. I obtained proof of my client’s family situation and his employment in Riverside County. I explained his willingness to pay restitution and comply with any condition that would allow him to continue to work.
Ultimately, I was able to convince the assigned Judge in Riverside County to allow for a probationary sentence with full restitution and a work program allowing for him to continue to work in Riverside and support his family.
Sometimes I am asked what “my winning record is” or how many cases I “win”. In the great majority of criminal cases, good attorneys do not completely exculpate their client or have the case entirely dismissed. Rather, in most cases, good counsel is provided through mitigation evidence that allows for a resolution of a case without devastating consequences. That is what I was able to secure for this man.
This probationary sentence will allow for the complaining witness to receive full restitution, save taxpayers the significant expenses of incarceration and support for a family in distress and allow for my client to continue to support his family in Riverside County. All the while, he will be monitored on probation in Riverside to keep him on a good path.
Finally, because he was given a probationary sentence by the Riverside District Attorney and assigned Judge in Riverside County, at the end of three years he will be eligible to apply for a reduction of the charge to a misdemeanor and the expungement of his criminal record. This I hope will be another reason beyond possibly going back to jail if there is a violation for him to walk a straight path.
