Charge: Grand Theft Auto – Penal Code Section 487
A client living in the South Bay was arrested by the Lomita Sherriff’s Department located at 26123 Narbonne Avenue in Lomita, CA, for allegedly violating California Penal Code Section 487, commonly known as grand theft auto. However, the Los Angeles County District Attorney’s Office in the Torrance Branch located at 825 Maple Avenue in Torrance, CA, never filed an accusatory pleading arising out of this arrest.
A month or two after the client’s arrest, she forwarded me her request to seal and destroy her arrest record pursuant to Penal Code section 851.8(a) to the Los Angeles Police Department, Lomita Sheriff’s Division. However, her request had been denied pursuant to penal code 851.8(a) which mandates that a request will be denied should the Sherriff’s department, in this case, the Lomita Sherriff’s Department, fail to respond to the request.
The facts of the case lead me to believe that her request should have been granted by the Lomita Sherriff’s Department and the Los Angeles County District Attorney’s Office, Torrance Branch.
On the day of her arrest, my client had been arguing with family members. One family member threatened that if she took the vehicle, they would call the Lomita Sherriff’s Department. However, the car was my client’s for all intents and purposes to drive throughout the cities of Rancho Palos Verdes and Lomita.
That day, the Lomita Sherriff’s Department called my client and ultimately was arrested.
My client was completely innocent of the charge of grand theft auto, which was further emphasized by the fact that the Los Angeles District Attorney’s Office in Torrance declined to file a case against her. Ultimately, after further persuasion by myself and my client, the Torrance District Attorney’s Office granted her motion and sealed her records. She no longer will face the stigma that the charge of grand theft auto carries.
