Charges: Fighting in a public place pursuant to California Penal Code section 415(1) and obstruction of a police officer pursuant to California Penal Code section 148(a)(1)
A client who was visiting Hermosa Beach, California was arrested by the Hermosa Beach Police Department located at 540 Pier Ave, Hermosa Beach, California.
As is common in the South Bay and in Hermosa Beach, many individuals spend time drinking alcohol at the beach. My client, a resident of Hermosa Beach, was no exception. He had been enjoying an afternoon with his girlfriend in Hermosa Beach when the two became too loud and aggressive.
Another Hermosa Beach resident called the Hermosa Beach Police to the client’s apartment and ultimately, the Hermosa Beach Police Officers arrested both individuals. In many cases, police officers will charge individuals with California Penal Code section 148(a)(1), which is a charge of the “obstruction of a police officer,” if the arrestee acts in any other way but cooperative. While officers should be treated with absolute respect, sometimes the “obstruction of a police officer” can be a relatively arbitrary and certainly a subjective charge based on that police officer’s interaction with the arrestee.
After providing a mitigation package to the Hermosa Beach Police Department and explaining the circumstances surrounding my client’s arrest, the Hermosa Beach Police Department formally dismissed all charges and my client never had to appear in court.
