Case History #1
Charge: Protecting the Rights of a Client Accused of Sexual Molestation
A family out of Carson were faced with dramatic circumstances. A mother and father of two children came to our office after the father had been placed under investigation for molestation of his daughter. Our client indicated that the investigator was putting a great deal of pressure on him to submit to a lie detector test. While the results of lie detector tests are inadmissible in court, the same is not necessarily the case with the information it uncovers. Thus, our client’s penal interests were being put to great risk by the pressures of the investigator located in Carson.
Upon retention, we immediately contacted the investigator. We prepared a letter indicating that our client would not be taking a lie-detector test. We further indicated that our client would be happy to go to the office in Carson with counsel and discuss the matter with him. In addition, my associate contacted the investigator twice and had telephone conferences in which she stated our client’s position and again protected our client’s interests.
Next, we prepared a mitigation package to be submitted to the Carson investigator. Mitigation packages are commonly used at the early stages of a case. They allow the accused to provide a background of themselves as individuals and often aid in settling a criminal matter.
Ultimately, after protecting the rights of our client, providing the investigator with a comprehensive mitigation package and discussing the matter with the investigator on a weekly basis, the case was rejected by the Los Angeles County District Attorney’s Office for filing consideration. This was due to the lack of evidence and the strong mitigating evidence we provided the detective.
